COURT UPHOLDS DISBANDMENT OF TIMARIV BY GOV. WIKE

By Egbule John

The National Industrial Court sitting in Port Harcourt has upheld the sack of staff of the Rivers State Road Traffic Management Authority by Governor Wike. Delivering judgment in a suit filed by disengaged staff of TIMARIV, Justice F. I. Kola-Olalere of the National Industrial Court sitting in Port Harcourt ruled that the staff of TIMARIV were lawfully sacked by the Rivers State Government. In Suit No.NICN/PHC/71/2018: Amachree MacJaja John & ors v. The Attorney General of Rivers State, the applicants had approached the court to determine the legality of their sack and disbandment of TIMARIV by the Governor of Rivers State.
The court held that staff of TIMARIV were not civil servants and their employment were not governed by the public service rules.

The Governor had in 2015 disbanded the Rivers State Road Traffic Management Authority, TIMA-RIV, alleging that the agency has become a nuisance with its officials extorting money from the people of the state. The court ruled that the disbandment of TIMARIV by Governor Wike followed due process in terms of their employment.
